eBay's 2009 Canadian Entrepreneur of the Year Awards
- Entry Period: The 2009 eBay Canada Entrepreneur of the Year Awards ( the "Competition") begins at 12:01 AM Eastern Time (ET) July 9, 2009 and ends at 11:59 PM ET and ends August 9, 2009 ("Entry Period"). No purchase necessary. Void where prohibited.
- Categories/Eligibility: This Competition is open only to legal residents of Canada who are registered members of www.ebay.ca or www.ebay.com (the "eBay Site") who sell on eBay full-time or part-time, who meet the eligibility criteria below, and have accounts in good standing during the entire Eligibility and Entry Periods ("eBay sellers"). Eligible entrants MUST also meet the following criteria between April 1, 2009 and June 30, 2009 ("Eligibility Period") in order to be eligible for the Competition: [1] achieve a minimum of $1,000 CAD in sales per month on the eBay Site; [2] post a minimum of ten (10) listings per month on the eBay Site; AND [3] have at least 98% positive feedback. Employees of eBay Inc., eBay International A.G., and its respective subsidiaries, affiliates, prize suppliers and advertising and promotion agencies of eBay Inc. and eBay International A.G., including Marden-Kane, Inc and individuals living in the same household with such employees are ineligible to enter or win. Void where prohibited by law. This Competition is subject to all applicable federal, provincial, local laws and regulations.
- How To Enter: To enter either Competition category, eligible participants must complete the registration form located at http://www.ebay.ca/entrepreneurs (registration form must be complete to be eligible), accept the official rules, and submit the required original essay. The essay must describe why and how you started your eBay business and how you decided what to sell on eBay; describe how your eBay business has evolved and how eBay has helped you achieve your business goals; and (if applicable) describe a significant business challenge you have faced and how you overcame it. The essay should not exceed 500 words. All submitted essays will be entered into the Entrepreneur of the Year category.
To enter the Comeback of the Year competition category eligible participants must submit an additional essay in the space provided. The essay must describe a personal or professional setback you experienced in the 18 months prior to July 9, 2009 and demonstrate how selling on eBay helped you overcome this setback. The essay should not exceed 500 words. (All essays described in this section to be collectively referred to as "Essay")
There is a limit of one entry ("Entry") per person and/or eBay User ID to the Competition. Entries may only be submitted online. By entering this Competition, winners agree to grant eBay International A.G., ("Sponsor"), its agents, subsidiaries and affiliates an exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, database rights and any other rights entrant has in the Entry, in any media now known or hereafter devised (including without limitation, the Internet), without additional compensation. Furthermore, each entrant agrees to waive their moral rights to the Essay and sign an agreement to this effect. Each entrant hereby represents and warrants that he/she is the original author of his/her Essay and the Essay will not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy. Sponsor's use of information submitted to Sponsor in connection with this Competition will be subject to the terms and conditions of these Official Rules and the eBay User Agreement available on the eBay Site. Entries must be received by 11:59 PM ET on August 9, 2009 in order to be eligible. "Entry (ies)" as that term is used herein shall mean the Essay and information provided by entrants to Sponsor and/or Marden-Kane in connection with the Competition. eBay International A.G. decisions are final on all matters relating to this Competition. Use of the eBay Site and all other international eBay web sites is subject to the eBay User Agreement and Privacy Policy available on the eBay Site.
- Judging of Essays and Determination of Winners: All qualified entries will be judged and scored by Sponsor according to the following criteria: The Entrepreneur of the Year category: (i) Degree of evolution of your business on the eBay Site - 20%; (ii) Degree to which eBay has attributed to your business' success - 15%; (iii) Degree to which community values on the eBay Site have been demonstrated - 35%; (iv) Creativity and originality of the answers presented - 15%; and (v) Clarity of writing and ability to communicate your answers well - 15%. The Comeback of the Year category criteria: (i) Your description of how your eBay business helped you overcome a personal or professional setback that affected you in the prior 18 months - 35%;(ii) Degree to which community values on the eBay Site have been demonstrated - 35%; (iii) Creativity and originality of the answers presented - 15%; and (iv) Clarity of writing and ability to communicate your answers well - 15%. Potential winners will be determined by Sponsor under the supervision of Marden-Kane Inc., the Competition administrator and an independent judging organization ("Marden-Kane" or "Administrator"). In the event of a tied score, the Essays involved in the tie will be reviewed by an additional judge who will serve as a tiebreaker and who will evaluate Essays according to criteria listed above. Decisions of judges are final and binding on all matters relating to this Competition. Becoming a potential finalist or winner is subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules.
Potential Finalists will be determined on or about August 31, 2009 from among all eligible Essays received. Finalists who receive a high score during the judging phase may be contacted by Administrator by mail and/or email to complete a publicity release. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any Entries, proper names, likenesses, photographs and Entry for advertising and promotional purposes in all media (including and without limitation, the Internet) without additional compensation, except where prohibited by law. Before being declared a potential finalist or winner, an entrant must correctly answer a mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise, to be administered at a mutually convenient time.
- Winner Notification: On or about September 1, 2009, Administrator will notify potential winners by mail and/or email. The potential winners will be required to sign and properly execute, an affidavit of eligibility, liability waiver, and where legal, consent to publicity, and return it within seven (7) days of issuance. If the prize notification is unclaimed or returned as undeliverable, or if a potential winner fails to properly execute and return all forms described herein, the prize will be forfeited and awarded to the next highest ranking Entry. If an entrant changes his/her telephone number, email address and/or street address after he/she enters the Competition, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to Marden-Kane's address (listed below) to be received by September 1, 2009.
- Prizes: eBay Canada Entrepreneur of the Year category prize will consist of:
a cash prize of $2,000 CAD, a $500 CAD credit to be used towards AdCommerce advertising, and $500 CAD towards a business course of the seller's choice. eBay Canada Comeback of the Year category prize will consist of: a cash prize of $1,000 CAD, a $500 CAD credit to be used towards AdCommerce advertising, and $500 CAD towards a business course of the seller's choice. Total Approximate Retail Value of all prizes: $5,000 CAD. Only one (1) prize per person will be awarded. No prize substitutions or transfer of prizes permitted except at the sole discretion of the Sponsor. All taxes and other costs not expressly assumed by the Sponsor are the responsibility of the individual winners.
- Limitation of Liability: By participating in the Competition, entrants agree to abide by the terms of these Official Rules and the decisions of the judges and release, indemnify and hold harmless the Sponsor, and Marden-Kane, Inc. and each of their, affiliates, subsidiaries and their respective agents, representatives, officers, directors, shareholders and employees (collectively, "Releasees") from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Competition or acceptance, possession, use, misuse or nonuse of the prize that may be awarded. Entrants agree that any and all disputes shall be governed by the laws of Canada. Releases are not responsible for printing or typographical errors in any Competition related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, access any web site associated with this Competition, or process any transaction thereon. Sponsor reserves the right, in its sole discretion to disqualify any Entry and to modify, terminate, or suspend this Competition should virus, bugs, non-authorized human intervention, action of entrants, or other causes corrupt or impair the administration, security, fairness, or proper play of the Competition and, if the Competition is modified, terminated, or suspended, select winners from those eligible, non-suspect entries received prior to event requiring such modification, termination, or suspension. Should the Competition be terminated or modified prior to the stated expiration date, notice will be posted on http://www.ebay.ca/entrepreneurs. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Competition is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with this Competition via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices or programs is prohibited.
