Recalled Items

eBay strongly supports the efforts of the Canadian Consumer Products Safety group of Health Canada (CPS) to protect consumers against potentially hazardous goods. eBay does not permit the listing of items that have been identified by the CPS as hazardous to consumers and therefore subject to a recall.

Violations of this policy may result in a range of actions, including:

  • Listing cancellation

  • Limits on account privileges

  • Account suspension

  • Forfeit of eBay fees on cancelled listings

  • Loss of PowerSeller status

Also, if you violate this policy, you may face civil and/or criminal prosecutions and be accountable to pay fines and/or damages with respect to federal, provincial or local laws or regulations.

Some Examples

Items that have been the subject of CPS action include (but are not limited to):

  • Baby walkers, booster cushions, child safety seats and child restraint systems

  • Baby products (such as defective cribs, infant carriers, toys and car seats)

  • Consumer chemicals and containers

Additional Information

Sellers on eBay should check with the CPS ensure that the products they're selling have not been the subjects of a CPS recall. The CPS protects consumers by issuing warnings about goods that might be hazardous, and even issuing recalls of certain products. Buyers on eBay should educate themselves about hazardous and recalled products. The CPS website and the Hazardous Products Act have information on regulations and recalled products.

In addition, sellers and buyers on eBay should not circumvent Canadian laws by listing prohibited products for sale or buying products for import into Canada from another eBay site.

Why does eBay have this policy?

eBay urges sellers and buyers comply with all applicable laws and regulations. Since the sale of recalled items is prohibited by law, regulated, or may cause harm to eBay or its users, sellers may not list them on eBay. This policy helps protect buyers and helps create a safer marketplace.
